Welcome to the Moodhoops website (“Site”). Please review the following basic terms that govern your use of and purchase of products from our Site. Please note that your use of our Site constitutes your agreement to follow and be bound by those terms (the “Agreement”).
When you visit moodhoops.com, with the help of our 3rd party authorized agents, we collect information (such as IP address, domain name, browser type, broad geographical information, site-navigation pattern, etc) to improve our website and to refine our marketing campaigns and promotions. We do not gather any personally identifying information about you when you visit this site, unless you choose to provide such information to us.
We collect certain personally identifiable information when you sign in to the Moodhoops web site, register for on-line shopping, participate in a contest, promotion or survey, or request other services that require information, registration or subscription. This information may include your name, billing address, phone number, e-mail address. We also keep a record of your product interests and purchases on-line and in our stores when you create an account, and automatically receive and record information on our server logs from your browser (including your IP address, Moodhoops cookie information, and the page you requested).
Please be aware that our site may contain links to other sites hosted by third parties. Moodhoops does not control and is thus not responsible for the content or privacy practices and policies of such other sites.
We hate spam as much as you do. We will NEVER send you any unsolicited junk e-mail. We will only contact you to answer your queries and/or send you information regarding your order and the order process.
3.) Declined orders
We reserve the right to, at any time after receipt of your order, to accept or decline your order or part of an order for any reason. In the event that an order or part of an order is declined we will refund the payment for the declined items. We also reserve the right to block customers from purchasing at our sole discretion for any reason. If a blocked customer attempts to circumvent the block their order will be cancelled and a cancellation fee will apply.
4.) Purchases, Returns and Refunds
All Returns must first get a RMA number issued by Moodhoops before the package is sent out to us.
We must be contacted about your return within 4 days of the date listed as your Delivery Confirmation date.
Please contact us for details on how to return your hoop.
If you are considering returning your hoop, poi, or staff please make sure you are practicing on carpeting or in dry grass. Hooping or spinning on hard or scratchy surfaces, such a concrete, gravel or tile, will scratch the surface of the tubing and make it ineligible for a full refund.
Shipping is non-refundable. Refunds will be issued via PayPal to the original account or card used to make the purchase. Any refunds processed after 60 days will need to be issued back through a PayPal account as a ‘Send Money’.
We strongly recommend using tracking on your package to return it to our company. We cannot be responsible for returned packages lost in transit to us. For additional peace of mind, consider using shipping insurance on your returned package.
We also reserve the right, at our sole discretion, to reject Returns of purchases that are not any one of the following: in original condition, free of scratches on the tubing, postmarked within 4 days of the date of the approved RMA code, including the battery(s) and charger, or breakage due to obvious water damage or misuse.
International orders are subject to the conversion rate and any associated fees through your bank and/or through PayPal. All products are listed as USD. We have no control over the conversion rate charged to you by your bank or by PayPal.
Please keep in mind that there may be delays when your package is going through customs that are beyond our control. Always try to order as far ahead in advance as possible so that your order can reach you with plenty of time.
All MoodHoops, FutureHoops, and FuturePoi come with a wall charger to recharge your batteries. Adapters to fit into non-US wall outlets are not included with your hoop, poi, or staff.
Customers outside of the US – Please note that we are not responsible for any duties, taxes, or levies that your country may impose on your shipment, as this is handled within the country of receipt. We have absolutely no control or jurisdiction over your government’s duty/tax assessment or whether a duty/tax is assessed at all (for many shipments a duty/tax is not charged).
We are required by US and international laws to list all purchases as Merchandise at full cost and so, per the law, we cannot state on customs forms that purchases are Gifts or change the Customs Value amount. We are required by law to include a copy of the invoice on the outside of the package and to state the value of the shipment.
Please keep in mind that covered warranty issues will have the repair and return postage covered/paid for by us, but purchasing the postage for sending the warrantied product back to us is paid for by the customer.
5.) Our site
From time to time there may be information on the site that contains typographical errors, inaccuracies, or omissions (we’re only human and mistakes, though rare, can happen). We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.
We may change, move or delete portions of, or may add to, our Site from time to time. Your use of our Site following any such change constitutes your agreement to follow and be bound by the terms as changed. We have made every effort to display, as accurately as possible, the shipping times and colors of our products online. However, since the actual color you see will depend on the make and model the monitor you are using to view the site, we cannot guarantee that your monitor’s display of any colors shade will be accurate.
You agree to defend, indemnify and hold the Site harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Site and/or the products purchased on this site.
7.) Cancelling an order
If your order has not yet been packaged or sent, it can be canceled and refunded. To cancel an order please contact us by email and refer to the PayPal Transaction ID number.
We guarantee arrival on all packages. We send all packages with Delivery Confirmation and reserve the right to send any package with Signature Confirmation. If a package does not have a confirmed delivery and is lost in transit, we will issue a refund or send out a new product to replace the lost one at our discretion.
Please note that this applies to instances where the package is lost by the Postal Service. It does not apply if you mistakenly gave us an address that is deemed undeliverable by the Postal Service and is Returned to Sender. In the case of orders that are marked Return to Sender by the Post Office, the shipping charges are non-refundable.
